Transelectrica says that it cannot intervene in the administration and management activity of SMART subsidiary, following the articles in the central press accusing the appointment of an incompetent person in the position of director within the subsidiary, according to a release.

“Both Transelectrica and SMART are public enterprises that are subject to the provisions of GEO 109/2011 on the corporate governance of public enterprises, as subsequently amended and supplemented. According to article 4 of GEO 109/2011, Transelectrica cannot intervene in the administration and management of the SMART subsidiary, the competence to take management decisions and management decisions of the public enterprise and the responsibility, under the law, for their effects resting with the board of directors. and directors.

“Given that the duties of hiring and firing the staff of a company are the sole responsibility of its management bodies, Transelectrica has no competence and has no information on the recruitment and hiring procedures carried out at SMART level,” say company officials.
