Court of Accounts: 35 mln. euro loss at Romgaz

The Court of Auditors found, following an inspection conducted this year at Romgaz, that the manufacturer had sold gas worth over 160 million lei (about 35 million euros) without complying with the law and asked the company to recover this damage, shown in an explanatory report on the convening of the Romgaz General Shareholders Meeting from August 11th.

In the document, the Board of Directors of Romgaz explains why it proposes to the shareholders to hire an experienced law firm to represent the company in the disputes with the Court of Auditors and the European Commission – according to Agerpres.

“According to some interpretations, which we consider to be biased and flawed of the legislation, made by Court of Auditors, the finding / decision obliges Romgaz to take action to recover large sums of money from different customers and trading partners, action that cannot be achieved only through the course of legal proceedings of a dispute (the ammount of the alleged damage / the Court of Auditors estimated the amount exceeding 160 million lei),” mentions the document.

Contacted by Agerpres, the Romgaz representatives indicated that they already filed an administrative appeal against the decision of the Court of Auditors, which it considers wrong on particular issues.

“The appeal is to be resolved, in legal terms, by the hierarchically superior authorities to those that carried out the control, in accordance with the legal provisions of the law regarding the organization and functioning of the Court of Auditors. Depending on the final decision that will be issued by the Court of Auditors, Romgaz will analyze and act accordingly, with the possibility of legally conferred by the Romanian legislature to address our competent courts for resolving these types of disputes,” it is said in the response of Romgaz.

The company representatives did not respond, however, questions about the irregularities found during the inspection Court.

The Romgaz officials also state in the AGA document that they will make use of all the legal means they will have on hand to defend their legitimate rights and interests, given that the measures ordered by the Court of Auditors,may result in significant losses and damages, in the Romgaz heritage damage.

“Moreover, the decision of the Court of Auditors also concerns the recovery of money from employees (see paragraph regarding the settlement ticket), the amounts received and some employees within the judiciary own”, shows the document.
