Competition launches investigation into the LPG port operation services market

The Competition Council has launched an investigation into a possible abuse of dominant position by Octogon Gas & Logistics on the liquefied petroleum gas (LPG) port operation services market.

Octogon Gas & Logistics SRL, owned by NSS Oil & Gas SRL, is the only company that provides port operation services (unloading/loading, handling/transferring, storage) of LPG in the Midia Port, the institution announced.

The competition authority claims that Octogon Gas & Logistics SRL refused to provide services to a company active on the liquefied petroleum gas wholesale market.

According to competition law, a company holding a dominant position may adopt the necessary strategies to defend its commercial interests, but such measures must be reasonable and proportionate to the effects they could cause. Thus, the refusal of a dominant company to provide products/services to a stable customer, without objective justification, may constitute abuse.

As part of the investigation, unannounced inspections were carried out at the registered offices and work points of the companies NSS Oil & Gas SRL and Octogon Gas & Logistics SRL.
