Casa Verde Photovoltaic program, suspended by a local court

The Casa Verde Photovoltaic program has been suspended since Tuesday, September 26, as a result of the Oradea Court of Appeal’s Decision admitting the request made by one of the installers which were not validated by the Environment Fund Administration.

“Starting today, September 26, 2023, the Casa Verde Photovoltaic Program is suspended as a result of the Oradea Court of Appeal Decision no. 199/2023 in the file 3168/111/2023 which admits the request made by the plaintiff Dhelectric Systems SRL, contrary to the defendant, the Environment Fund Administration. Through this decision, it was decided to suspend the execution of the Decision to resolve the appeal regarding the rejection of the validation file of the plaintiff Dhelectric Systems SRL as an installer published on the AFM website on August 28, 2023, and to suspend the entire procedure for publishing the the list of validated installers, for their selection by the beneficiaries and for the conclusion of the participation and financing contracts until the final resolution of the case that is the subject of file 3168/111/2023,” reads an AFM press release, quoted by Agerpres.

The Environment Fund Administration mentions that it will submit an appeal to the Oradea Court of Appeal in order to unblock and resume the Casa Verde Photovoltaic 2023 Program as soon as possible.

The institution states that it has followed exactly all the procedures regarding the validation/invalidation of installers provided for in the Casa Verde Photovoltaic Program financing guide, including in the case of the rejection of the file submitted by Dhelectric Systems SRL.

“Thus, on May 12, 2023, the Environmental Fund Administration requested, through the IT application related to the Casa Verde Photovoltaic Program, in accordance with art. 12, paragraph (2) of the Financing Guide, the installer Dhelectric Systems SRL to upload application within 5 working days the certificate issued by ANRE of type B or other certificates that include the competences of type B, being a document that was missing from the file submitted in order to participate in the program. According to article 12, paragraph (3) of the guide , the lack of this document leads to the rejection of the validation request if it is not sent to the institution through the computer application related to the Casa Verde Photovoltaic Program within 5 working days. As a result of not uploading the missing document in the computer application within 5 working days, the file of the installer Dhelectric Systems SRL was rejected,” the statement also says.

The institution specifies that the decision to reject the file was contested by the installer Dhelectric Systems SRL. Also, following the reanalysis within the Appeals Resolution Commission, the reason for rejection was confirmed, a decision that was posted on August 28, 2023 on the AFM website.

The Environment Fund administration states that it will make every effort to clarify the situation and to unlock and resume the Photovoltaic House Green Program as soon as possible.
