The new draft energy law introduces over 100 amendments in 80 articles

Romanian energy legislation is extremely volatile, difficult to follow or understand, inconsistent and with hurdles, says Dana Dunel Stancu, Head of Energy & Sustainability Practice, Biriș Goran, according to Profit.ro.

Thus, the new draft of the energy law brings a radical change in the area of electricity, with over 100 amendments to the 80 articles, and the Chamber of Deputies is debating the approval of a text similar to Ordinance 74/2020, which reconfirms the impossibility of to conclude direct bilateral contracts on the energy market.

“These inconsistencies are not new and it is very sad that they still continue, especially since we are talking about a declared desire to have a free market in which all participants know their rights and know what to do. If the market wants to be more and more open, it should be more and more permissive. If the market wants to be more and more permissive, everything that means regulations should be friendlier and easier to access,” said Dana Dunel Stancu.

“It is possible that a legal norm today will look one way, in 2 months it will look different. Or, at the other end, the legislative blockages: we are waiting for legal norms to be adopted, we know that they will be adopted, submitted under public debate, but they do not end up having a normative and obligatory form,” she said.
