The law on the extension of prosumer rights initiated by UDMR senator Antal Lóránt was published in the Official Gazette and, with its promulgation, in no more than 10 days, enters into force. The normative act brings some of the most important changes in recent years for prosumers in Romania and offers new rights to both households and legal entities.
“Today is an important day for the hundreds of thousands of prosumers in Romania. After almost three years of work, the law becomes a reality and offers concrete rights to those who have chosen to invest in energy independence,” says Senator Antal Lóránt, chairman of the Senate Committee on Energy, Energy Infrastructure and Mineral Resources.
For prosumers with installations of up to 27 kW, the law introduces the monthly settlement of surplus energy delivered to the network, instead of the current term of 24 months. At the same time, they will be able to offset the energy surplus with other consumption points, regardless of the distribution area, provided that they have the same supplier. In addition, under the condition that the supplier is identical, the amounts resulting from the offset will also be able to be used to pay natural gas bills.
Prosumers with installations between 27 and 200 kW also benefit from monthly settlement and will be able to use the energy surplus to offset consumption in other consumption points, if they have the same supplier and the same distributor.
In the case of legal entities that own installations with a capacity between 200 and 400 kW, the law introduces the right to financial regularization for the energy delivered to the network, which will be remunerated at the weighted average price of the Day-Ahead Market (DAM).
“This law responds to real problems, reported by prosumers for years. We have built each provision following the dialogue with those directly involved, so that the new rules are fair, applicable and for the benefit of those who produce energy,” Antal Lóránt emphasizes.
The initiative was submitted to Parliament in 2023 and went through a legislative process of almost three years, including a review process. During this period, consultations took place with representatives of prosumers, authorities and the energy sector, and the text of the law was successively improved to meet the real needs in the field.
After being adopted in Parliament, the law also passed the constitutionality test, with the Constitutional Court rejecting the objections raised and confirming the constitutionality of the normative act. The last stage is today, the publication of the Court’s decision in the Official Gazette of Romania, Part I, no. 594 of July 21, 2026 and its promulgation within ten days at most by the President of the State.
“There were times when many said that this law would never come into effect. Today we prove the opposite. We went all the way and respected the commitment made to prosumers. Very likely, with this victory, many will appear who will try to claim the success of this project in their own name, but the real winners today are the citizens who produce energy and contribute, through their own investments, to strengthening Romania’s energy security,” concludes Antal Lóránt.
