Competition: No deposits for wholesalers

The Competition Council regards as beneficial the initiative of the National Agency for Fiscal Administration (ANAF) to eliminate the obligation of holding own deposits by the wholesale traders of energy products.

Last year, ANAF, through the “Procedure for registration of economic operators trading in wholesale or retail energy products”, introduced the obligation “to have adequate storage space, in ownership or use – lease contract, comodate or any legal title” and to carry out all trading operations with the physical reception and delivery of these storage facilities.

If they did not own their own warehouses, many distributors of wholesale energy products would not have been able to carry out their business, thus being eliminated from the market, the Council said.

ANAF announced that it would eliminate these conditions imposed on all operators who trade wholesale energy products, but stressed that, if the activity requires the use of storage facilities, the conditions for their control and supervision remain valid.
