Competition Council will publish a blacklist of companies that have been sanctioned for rigging tenders

The Competition Council will publish in the next period a black list of economic operators who have been involved in investigations related to the rigging of some tenders, in order to come to the support of the evaluating authorities, according to a release.

The Competition Council and the National Agency for Public Procurement (ANAP) have developed a document, “Common Opinion”, which clarifies the ways in which a company that has been sanctioned for participating in a cartel-type cartel agreement can be rehabilitated if it is in the situation of being excluded from an award procedure, according to Agerpres.

Thus, the company can present to the contracting authority decisions issued by the Competition Council in the last three years proving that it has collaborated with the institution by applying to the policy of leniency and/or recognition of anti-competitive deed, as well as evidence on developing and implementing a compliance program in the field of competition, in accordance with the Guide on compliance with competition rules.

At the same time, contracting authorities are free to assess on a case-by-case basis the measures taken by economic operators and the evidence submitted by them.

“In order to support the evaluating authorities, the Competition Council will publish on its website an updated list (blacklist) which will include the names of economic operators who have been involved in investigations into auction fraud, sanctioning decisions in the last 3 years, as well as mentions regarding the way of their cooperation with the national competition authority,” it is also shown in the release.
