Senate voted negatively the possibility of concluding bilateral contracts (PPAs)

The possibility of concluding bilateral contracts for the sale of electricity, much demanded by the market in order to make investments in the sector and introduced by the Government in legislation, was annulled by the Senate, and the law will go next to the Chamber of Deputies, according to -nergia.ro.

Last month, the Government approved the Emergency Ordinance no. 74/2020 for amending and supplementing the Law on Electricity and Natural Gas, which, among other provisions, gave the possibility for those who invest in electricity generation capacities to be able to sell energy freely, on the market, without necessarily trading electricity in the markets hosted by OPCOM. That is, to finally allow the famous PPAs – purchase power agreements.

The one who amended the article by which the PPA is re-banned is the president of the Economic Commission, senator Gheorghe Marin. Here is his motivation: “In the form proposed by GEO 74/2020, the producers received a right that is not enjoyed by their trading partners (other than the producers), meaning those market participants who buy energy. At the same time, it is not clear why the provision applies only to the production capacities put into operation after June 1, 2020 and the period for which this exemption is valid is not specified either.”
