Final decision: Wind industry will no longer pay the tax on the turbine tower

Wind power producers will no longer pay the tax on turbine support poles, which is required by an older provision in the Fiscal Code, which assimilated the tower to a building, therefore for which tax was due. This is what the Supreme Court finally decided, after the Ministry of Finance lost the lawsuit with the lawyers from Țuca Zbârcea & Asociații, according to e-nergia.ro.

“The High Court of Cassation and Justice (HCCJ) maintained, by the decision pronounced on June 17, 2020, the decision by which several companies in the field of wind energy had obtained in the first instance the annulment of the Order of the Minister of Public Finance no. 1210/2014 and the Decision of the Central Fiscal Commission no. 5/2014,” shows a release of the law firm.

Five of the most important companies active in the renewables sector, represented by Țuca Zbârcea & Asociații, initiated the action suit having as object the request for annulment of the Order of the Minister of Public Finance no. 1210/2014 and the Decision of the Central Fiscal Commission no. 5/2014. Other companies in the field of wind energy later joined this action, the lawyers also say.
