Competition published a blacklist of 35 companies that rigged public tenders in the last three years

Competition Council published on its website, for the first time, the black list of companies that were involved in investigations regarding the rigging of public tenders.

The list contains a number of 35 companies that have been involved in investigations into bidding, the sanctioning decisions of the last three years, as well as mentions on how to cooperate with the national competition authority.

The most recent case, concluded last year, was the one in which Siveco Romania and Intrarom were sanctioned for violating the EU Accession Treaty through concerted market sharing practices in the case of an auction organized by APIA, according to Agerpres.

The competition institution decided to publish this list in order to support the evaluating authorities.

The Competition Council and the National Agency for Public Procurement (ANAP) announced on Wednesday that they have drawn up a document, “Common Opinion”, which clarifies the ways in which a company that has been sanctioned for participating in a cartel agreement aimed at frauding auctions may be rehabilitated if they are excluded from an award procedure.

Thus, the company can present to the contracting authority decisions issued by the Competition Council in the last three years proving that it has collaborated with the institution by applying to the policy of leniency and/ or recognition of anti-competitive deed, as well as evidence on developing and implementing a compliance program in the field of competition, in accordance with the Guide on compliance with competition rules.
